COMMUNITY RULES & REGULATIONS
Thank you for making Riverest your home. Even
though Riverest is known as one of the friendliest communities
in the area, with your help and cooperation, the following rules
and regulations have been established to ensure continuance of
this atmosphere.
1. It is the specific policy and intent of Community
management that this park be designed, operated and maintained for
the use and benefit, and to meet the social and physical needs of
persons 55 years of age and older. As such, the Community shall
adhere to the requirements of the Housing for Older Persons Act of
1995. Consequently, at lease one occupant of every mobile home
must be 55 years of age and older, except permanent full-time care
givers whose presence is required by a licensed physician. Under
the Act, management may, at its sole discretion, make certain
exceptions to this rule. In the event the oldest occupant of a
mobile home dies or vacates the mobile home, the remaining
occupant may continue as a resident of the Mobile Home Community
and an occupant of said mobile home so long as at least 80 percent
of the occupied homes in the Community, including that occupied by
the remaining resident, are occupied by at lease one person 55
years of age or older. A survey to determine compliance of these
occupancy requirements is required by rules promulgated by the
Department of Housing and Urban Development, 24 C.F.R.s.s. 100.307
(f) is hereby establishing this rules to require compliance by
residents with the age verification procedures established by the
Community.
At the time of application for initial occupancy, or on demand of
Community Management, all prospective residents and all existing
residents shall be required to produce for inspection and copying
one the following age verification documentation for verification
that at least one person residing in the home is 55 or older:
driver's license, birth certificate, passport, immigration card,
military identification, other valid local, state, national or
international documents containing a birth date of comparable
reliability.
2. PETS (begins 10/1/08)
a. Pet Registration: The only pets allowed in the
Community are cats. Prior written approval from Community
Management must be obtained as to any cat which is to reside in
the Community, and such written approval must be obtained prior
to the time the cat is actually brought into the Community. No
more than two (2) generally accepted domestic cats which have
been approved and registered by the Community Manager are
allowed per household.
b. Leashes: Cats must be kept inside the home or
if outside, the cat must be on a leash accompanied and
supervised by the resident at all times. While the cat is
outside, resident shall be responsible for any clean-up needed.
No cats are allowed to roam freely in the Community.
c. Collars/Vaccinations: Cats
must wear necessary registration from the appropriate
governmental agency and must obtain all required vaccinations.
d. Pet Removal: Any
cat not properly registered must be removed from the Community.
If the Community Manager finds the conduct of a pet to be
dangerous or bothersome to other residents, its registration
will be terminated and the pet must be removed.
e. Cancellation of Pet
Privileges: Should pet management become a problem in the
Community, the Community Manager reserves the right to refuse
admission to all further new and/or replacement pets.
3. Community speed limit is 10 miles per hour! Please tell
your friends and service people. Help us make this a safe place to
live.
4. All overnight guests must be registered at the
Community office on arrival. A guest is defined as a person whose
stay at the request of the mobile home owner hoes not exceed 15
consecutive days or 30 total days per year, unless such person
has the permission of the community owner or unless permitted by
a properly promulgated rule or regulation. All guests are
entirely the responsibility of their resident hosts and must
comply with Community Regulations, including regulations
regarding pets. Guests who are unruly or who create disturbances
will be asked to leave. Prior approval must be provided in
the event a mobile home is sub-let or loaned out for the use of
others. Definition of "sub-let": Anyone using your coach when you
are not there, Sublets must be persons age 55+, Maximum of
3 tenancies per year or any sub-let for three consecutive years.
5. Tenants without phones, please note: In the event of
emergency calls (Interpreted as serious illness, accident or
death) every effort will be made to promptly notify you or your
guests. Social phone calls will be discouraged. The office number
is 352-343-7780.
6. All rents must be paid in advance, not later than the
5th of the month; Rental rates are based on one or two occupants
per site.
7. Visitors are welcome, but children should be under adult
supervision at all times (must be under adult supervision when
using the shuffleboard courts and are not permitted to play on or
around the boat docks, in boats, or along the canal wall.
8. No parking or driving on grassy area. No parking on any
street. Park in driveways or designated parking areas. No
parking in your neighbor's driveway without written permission
from the homeowner filed in the office.
9. Loud noises should be kept to a minimum. Please observe the quiet time between 10:00 p.m. and 8
a.m.
10. The use of alcohol, loud, profane or vulgar language
will not be permitted in any public area of the Community.
11. All outside storage must be under the mobile home or in
a utility room, not in the carport. All mobile homes must be
anchored in accordance with Florida Statutes, and skirted.
12. All mobile homes and appurtenances must be kept clean
and well painted. In the event a resident does not adhere to this
standard, the management, after prior written notice reserves the
right to enter upon the premises and do the needed work and charge
to the owner's account. In the event the needed work is not
economically feasible (exceeds 50% of home value) then the
Community owner shall declare the home in unacceptable condition
and order its removal from the Community.
13. There will be no hanging of towels, wearing apparel,
swimsuits or other items anywhere around your mobile home. Please
use the drying lines provided. The laundry room will be open 7
days a week. Laundry room
hours are 7:00 a.m. to 9:00 p.m.
14. Garbage must be placed in approved containers provided
by the City of Tavares. Garbage must be bagged. Garbage
and trash are collected on Wednesday. Garbage should be put out for
collection no earlier than necessary to ensure pick-up and empty
cans should be promptly returned to their normal storage places.
15. Boats and/or trailers will not be permitted on lots.
Use the storage area. They may be stored in carports only during
resident absence or by special permission from the management.
Written permission must be obtained to store a boat and/or trailer
on a lot or carport not belonging to the boat/trailer owner. No
storage is permitted for any vehicles, boats, etc., not belonging
a Community resident.
16. Temporary or permanent exterior additions, of any type,
are to be discussed with and meet the approval of management
before work is started. Work done without approval may have to be
removed at resident's expense if it violates building codes. You
are responsible for the workmanship (which must meet Gov't codes)
and for any effects thereof to others at anytime.
17. No peddling, soliciting or commercial enterprises will
be permitted in the Community unless it will benefit all residents
equally, and then only by concurrence from management.
18. Walkways in the boat docks must be kept free and
unobstructed at all times. No storage of fishing equipment or gas
tanks other than in your boats. No additions to existing boat
docks or the building of additional boat docks may be made without
prior management approval.
19. Satellite dishes may be attached to the mobile home
after management approval.
20. Tenants will maintain general housekeeping of their own
yards, drives and carports. In the event the tenant does not keep
his yard mowed and/or raked, the shrubbery trimmed and drive and
carport clear, management reserves the right to enter upon the
premises and do the necessary work so that the lot will meet the
standards of good housekeeping. Costs will be charged to the
tenant's account except during the resident's summer absence at
which time management will assume the responsibility for lawn
mowing at reasonable intervals.
21. Management shall be notified whenever a mobile home is
listed for sale. "For Sale" signs shall be mounted on or in the
mobile home and shall not exceed standard (12" x 18") size.
Potential purchasers must meet with management prior to the
transfer of title to be approved. Lot rent is subject to review at
the time of sale.
22. Management reserves the right to refuse admission to
the Community of any mobile home.
23. Management reserves the right to refuse service to any
persons they consider undesirable and the right to evict anyone
who refuses to comply with any of the rules and regulations as are
herewith set forth.
24. Normal office hours are 9:00a.m. to 12:00 noon for the
first five business days of each month excluding Saturday,
Sunday and Holidays.
25. Recreation Hall, Restrooms, Kitchen, Shuffleboard
courts are OPEN AT ALL TIMES, except that the recreation hall may
be locked after dark before special events.
26. Tools are for use by residents. Those tools kept in the
Shop carport area may be borrowed at will. Please return promptly!
To borrow or use any of the management's tools inside the shop you
MUST ASK PERMISSION.
27. Every prospective resident is
required to provide adequate proof of liability insurance to the
community office each year.
The owner and management of Riverest Mobile Home Community absolve
themselves from all liability or responsibility pertaining to loss
by fire, theft, or accident to mobile homes, cars, boats, travel
trailers, or motor homes located in the Community or the Community
storage area. We also absolve ourselves from all liability or all
responsibility of any and all personal injury from any cause
whatsoever, to any resident, guest, visitor, or service personnel.
These rules are for your protection and with your cooperation we
can all live and enjoy life as good neighbors. If you want to
discuss these rules at any time, or have a complaint please
discuss it with management, not your neighbor.
